Welcome to MOWAVE Creative Studio!
These Terms of Service govern your use of our website and services. By accessing or using our site, you agree to comply with these terms. If you do not agree, you may not use our services.
1. Services Provided
MOWAVE Creative Studio offers branding, visual identity, communication design and related creative services. All deliverables are scoped and agreed upon before any project begins. Requests outside the agreed scope are subject to separate discussion and additional fees.
2. Project Process & Approvals
Every project follows a structured four-stage process — Discovery & Strategy, Creative Direction & Design, Refinement & Approval, and Delivery & Support. Client input is required at defined milestones. Delays caused by late feedback or unavailability may affect project timelines.
3. Revisions
Each project includes up to five minor refinements after final delivery, to be requested within 30 days of completion. These are intended for small adjustments — not structural changes or new directions. Requests beyond this scope are treated as new work and quoted separately.
4. Payments
A deposit of 50% is required to initiate any project. The remaining balance is due upon final delivery, before files are transferred. Late payments may result in project delays. All fees are non-refundable unless otherwise specified in your agreement.
5. File Delivery & Ownership
Upon receipt of final payment, clients receive all production-ready files in agreed formats — including PNG, SVG and PDF. Source files and editable formats (Figma, AI) are available with our Brand System + Growth package or as a separate add-on. Ownership of all delivered materials transfers to the client upon full payment. MOWAVE retains the right to showcase the project in portfolios or marketing materials and archive project files internally for quality purposes unless otherwise agreed.
6. Intellectual Property
MOWAVE Creative Studio retains the right to showcase completed projects in portfolios and marketing materials unless confidentiality is requested in writing prior to project start. Clients may not copy, modify or distribute MOWAVE's own intellectual property, methodologies or internal materials without written permission.
7. Confidentiality
MOWAVE treats all client information — including brand strategy, business plans and unreleased materials — as strictly confidential. This information will not be shared with third parties without prior written consent.
8. Client Approval & Responsibilities
Clients agree to provide accurate information, materials and timely feedback required for the project. You are responsible for ensuring that any content or materials supplied to MOWAVE do not infringe third-party rights.
The client is responsible for reviewing and approving all materials before final delivery. Once approval is given, MOWAVE Creative Studio is not liable for errors, omissions or changes requested after the fact.
Where a project depends on content provided by the client — including text, images or existing brand assets — delays in delivery may affect the project timeline. MOWAVE reserves the right to adjust deadlines accordingly, without penalty.
The client warrants that all materials supplied to MOWAVE are owned by them or properly licensed for use. MOWAVE accepts no liability for third-party claims arising from client-supplied content.
9. Limitation of Liability
MOWAVE Creative Studio is not liable for indirect, incidental or consequential damages arising from the use of our services. We are not responsible for client misuse of delivered materials or third-party interference after delivery.
10. Project Timeline & Suspension
MOWAVE reserves the right to terminate services if the client breaches these terms. Any outstanding fees remain payable upon termination. Files will only be transferred upon receipt of all payments due.
If a project remains inactive for more than 30 days due to lack of client response or missing materials, MOWAVE reserves the right to suspend work. Resumption of the project may be subject to rescheduling and additional fees.
11. Amendments
MOWAVE Creative Studio may update these terms periodically. Continued use of our services after updates constitutes acceptance of the revised terms. Clients will be notified of significant changes where applicable.
12. Governing Law
These terms are governed by the laws of Portugal. Any disputes arising from these terms or our services shall be subject to the jurisdiction of the Portuguese courts, regardless of the client's location or place of business.
